DEVELOPMENT UPDATE
The appeal before the Ontario Municipal Board by Verdiroc Developments (a Greenwin company) seeking approval to build an 8 storey rental building (plus a 5 metre rooftop mechanical penthouse) on the south side of Keewatin Avenue directly across the street from the low rise neighbourhood, commenced January 14th, 2013. The hearing was conducted before Chair Sylvia Sutherland and took the full week. The Chair has reserved her ruling in order to consider all of the evidence presented and will release a written decision in due course.
The Sherwood Park Residents’ Association (SPRA) was a party to the appeal and hired a Planner and a Lawyer to represent the interests of this neighbourhood and all of those City-wide that are on the border of apartment neighbourhoods that would be negatively affected by the precedent that this would set. Expert and professional representatives of the Sherwood Park Residents’ Association contributed to and attended the hearing every day, at no cost to the Association.
We feel that the adjudicator appreciated the issues and arguments presented on behalf of SPRA and that they will be given serious consideration. Our task was most difficult given the fact that the City staff chose not to object to the development in principle. The developer employed a significantly larger team of highly paid experts and expended far more resources than those available to SPRA. That notwithstanding, we feel that we presented the best case possible and are hopeful that the result will recognize our efforts.
While the decision is not in, the final invoices from our lawyer and planner have been submitted. The fees are somewhat higher than we were able to collect prior to the commencement of the hearing. They are certainly not undeserved. As a result, SPRA is in serious need of additional cash contributions to settle our accounts.
